Ensure two juvenile’s granted bail in DSP’s killing are sent home

After taking note of apprehensions of the defense counsel that the police might re-arrest the two juveniles who were granted bail on Friday in connection with the lynching of a deputy superintendent of police and implicate them in false cases, a court directed the police and Harwan Juvenile Home authorities to accompany the duo the Home.
Defense counsels Mushtaq Ahmad Dar and Arzaan Ahmad Dar moved an application to the in charge officer of the Juvenile Home, asking him to ensure proper handover and custody of the juveniles to their parents.

“It is requested to appoint an officer who, as per the law and Supreme Court directions, shall ensure implementation of the court order and accompany the juveniles to their place of residence,” the defense had submitted before the chief judicial magistrate.
However, the order of the CJM, a copy of which is with Kashmir Post, reads, “The in charge (of the) Juvenile Home on one or the other pretext is avoiding to release the juveniles under rules that provide for facilitating the transfer of juveniles or their restoration to their families.”
The order said the in charge Juvenile Home has “disobeyed, disrespected and disregarded the order”.

And SHO Nowhatta, the order reads, “is trying to implicate the said juveniles in false and frivolous cases without following due procedure of law”.
The Jammu and Kashmir Juvenile Justice Care and Protection of Children rules clearly state that the district child protection unit shall coordinate and implement all child rights and protection activities, which include facilitating the transfer of children at all the levels for either their restoration to their families or placing the children in long or short term rehabilitation through institutionalisation and sponsorship.
After going through the application of the defense counsels, the CJM directed the in charge Juvenile Home “to provide all the facilities to the juveniles and hand them over to their parents”.

“In case the district protection officer needs any assistance from the police concerned, the police shall provide all the assistance besides escorting the juveniles to the place of their residence,” the CJM’s order said.
