No unregistered coaching center should function in JK - HCThe Jammu and Kashmir High Court has sought details on all unregistered tuition centers operating in Kashmir. It has also directed the government to fix pupil-teacher ratio in coaching centers.

Hearing a Public Interest Litigation seeking implementation of J&K Regulation of Private Tuition Centres Rules of 2010 and other directions on related issue, a division bench of Justice Muzaffar Hussain Attar and Justice B S Walia directed Divisional Commissioner Kashmir to provide list of un-registered coaching centers operating in Kashmir Division.

While divisional commissioner Kashmir was asked to inform the court whether all unregistered coaching centers were closed or not, he was also directed to ensure that no un-registered coaching center was allowed to function in the Kashmir Division.

Following the submission that pupil-teacher ratio maintained by tuition centers has adversely affected the teaching standard, the court directed the government to form norms for fixing pupil-teacher ratio with the assistance of experts.

Directing the government to issue appropriate order for implementation of fixing the student-teacher ratio, the court sought compliance report by Commissioner Secretary Education Department and Divisional Commissioner Jammu and Kashmir before the next date of hearing.

In response to a submission while the court asked Divisional Commissioner Kashmir to furnish list of registered tuition and coaching centers to the concerned bank authorities to enable these centers to operate their bank accounts, it, however, said that other “un-registered coaching Centres shall not, in keeping with court directions, operate their bank accounts till further orders from the Court.

Meanwhile, the court directed its Registry to provide copy of the inspection report of the Judges Committee—constituted to inspect the coaching centers- to counsel for the parties. “The parties shall be at liberty to file response to the said inspection report,” the court said.

In a separate direction, Divisional Commissioner was directed to ensure that Court orders passed from time to time and the government order of 2010 is implemented throughout length and breadth of Jammu Division.

In his compliance report, Divisional Commissioner Jammu has stated that a meeting approved registration of 10 tuition/coaching centres and Director School Education Jammu was requested to register the said centres provisionally for one year in consonance with Jammu and Kashmir Regulation of Private Tuition Centres Rules, 2010.

The report said that all the Deputy Commissioners were directed to inspect Tuition/Coaching Centres alongwith Chief Education Officers and submit the inspection report, so that appropriate recommendations are made for their registration to the Director School Education, Jammu.

Pertinently, On February 3 this year, the High Court had directed Divisional Commissioner Kashmir to close all coaching centres in the Valley if they failed to file an undertaking before Registrar Judicial within three days in compliance to its directions issued on December 30 last year.
