No fresh grounds to detain Alam: JK Government

Jammu & Kashmir government in its report to the Union Home Ministry has made it clear that Masrat Alam has been bailed out in all the cases against him.
According sources, the report has added that Alam was detained under the Public Safety Act (PSA) “intermittently” since February 4, 2010 and there are “no fresh grounds” for his continued detention, therefore, he has been released. The last time Alam was booked under PSA was September 24, 2014, the report sent to the MHA says.
“As per Section 18(1) (b) of PSA Act, a person whose activities are prejudicial to the security of the State can be detained for six months in the first instance which can be

extended up to two years. Further, the Hon’ble High Court has laid down that a person cannot be detained twice under the same grounds. For fresh detention, there need to be fresh grounds, Masrat Alam has been detained 8 times since 2010 and there are no fresh grounds for booking him under PSA,” the J&K Government report, according to sources, has said.
The report says Alam was detained under PSA twice in 2010, 2011, 2012 and 2014 – pushing him behind bars for almost five years now. It also specifies that out of the 27 FIRs registered against Alam since 1995, he has been charge-sheeted in nine cases while 16 other cases are “still under investigation”.
